Fitness Center – Privacy Policy

This Fitness Center – Privacy Policy (“Privacy Policy” or “Policy”) applies to member information collected by the fitness centers (“Fitness Centers” or “we” or “our”) owned or operated by Premise Health Employer Solutions, LLC (“Premise Health”).

This Privacy Policy describes the types of information that the Fitness Centers may collect from a member in connection with the fitness center services (“Fitness Center Data”), and our practices for collecting, using, maintaining and disclosing Fitness Center Data.

This Privacy Policy does not apply to:

  • Member health information Premise Health maintains in accordance with the Health Insurance Portability and Accountability Act and its implementing regulations (HIPAA), including information maintained in the secure member portal (called My Premise Health), or information used to access My Premise Health (e.g., log-in information). That information is governed by the Notice of Privacy Practices, which is available at the Privacy & Compliance Policy Center.
  • Information Premise Health collects from users of premisehealth.com and any other public websites owned and operated by Premise Health. That information is generally governed by the Website Privacy Policy, which is available at the Privacy & Compliance Policy Center.
  • Job applicant information Premise Health collects (including but not limited to information collected through jobs.premisehealth.com) or information Premise Health collects from its employees/personnel. That information is subject to other notices available at the Privacy & Compliance Policy Center.
  • Third-party websites and applications and Bluetooth devices. The Fitness Centers may have equipment that provides links to websites or the ability to connect to an external site or application or to your Bluetooth device for your convenience. These websites, applications and devices operate independently from the Fitness Centers and may have their own terms and privacy policies.  We encourage you to review those terms and policies to understand how those third-party websites, applications or devices collect, use, and share your information. Premise Health is not responsible for content, any use, or the privacy practices of any third-party website, application or device to which you connect through the fitness equipment.

Please read this Privacy Policy carefully to understand our policies and practices regarding your information. As a member of a Fitness Center, you agree to this Privacy Policy (which includes a Fitness Center – State Privacy Law Addendum).

The current version of this Policy is available at the Privacy & Compliance Policy Center and at each of the Fitness Centers.

Children’s Privacy

To the extent a child under the age of 18 uses the services provided by a Fitness Center, we comply with all applicable laws and regulations governing children’s privacy.  If you have any questions about our privacy practices relating to children, please contact us at [email protected].

Information We Collect

We collect the following categories of information that identifies, relates to, describes, references, is capable of being associated with, or could reasonably be linked, directly or indirectly, with an individual (“Personal Information”):

  • Identifiers, such as first and last name, alias, signature, address, telephone number, unique personal identifier, email address and account name;
  • Personal characteristics, such as gender and characteristics included in responses to physical activity readiness questionnaire;
  • Various measurements, such as height, weight, body mass index (BMI), body fat, blood pressure, resting heart rate (HR) and waist-to-hip ratio.
  • Professional or employment information, including employer name; and
  • Financial information, such as bank account number, credit card number, debit card number.

If a Fitness Center member is working with a fitness coach, the fitness coach may also collect health-related information from the member, such as health condition, health-related treatment, diseases or another mental or physical health diagnosis, surgeries or other procedures or medications.  In these circumstances, the Fitness Center member can decide what information to share with the fitness coach.

Personal Information (as that term is used in this Policy) does not include:

  • Publicly available information.
  • De-identified or aggregated consumer information.

We obtain the categories of Personal Information listed above from the following categories of sources:

  • Directly from our clients (e.g., employers). For example, from documents that our clients provide to us related to the services for which they engage us.
  • Directly from our Fitness Center members. For example, through information we collect from our members in the course of providing Fitness Center services to them.

How We Use and Disclose Your Personal Information

We may use or disclose Personal Information we collect for one or more of the following business purposes:

  • To provide you with information, products, or services that you request from us.
  • To provide you with email alerts, event registrations, and other notices concerning our products or services or events or news that may be of interest to you.
  • To carry out our obligations and enforce our rights arising from any contracts entered between you and us, including for billing and collections.
  • To respond to law enforcement requests and as required by applicable law, court order, or governmental regulations.
  • To evaluate or conduct a merger, divestiture, restructuring, reorganization, dissolution, or transfer of some or all of our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which Personal Information held by us is among the assets transferred.

We may also share your Personal Information with health care providers affiliated with Premise Health so that those providers can treat you or provide health care or other services to you.

We will not collect additional categories of Personal Information or use the Personal Information we collect for materially different, unrelated, or incompatible purposes without providing you notice.

We may disclose your Personal Information to a third party or our affiliates for a business purpose. When we disclose Personal Information for a business purpose, we enter a contract that describes the purpose and requires the recipient to both keep that personal information confidential and not use it for any purpose except performing the contract.

We do not:

  • share your Personal Information with nonaffiliated companies for their direct marketing purposes, unless we have your permission; or
  • sell your Personal Information.

State Privacy Laws

Some state laws provide Fitness Center members with certain privacy rights. For more information about state laws that may apply to information collected by the Fitness Centers, please see our Fitness Center – State Privacy Law Addendum.  To the extent a state law defines terms used herein or has more stringent requirements, those terms and requirements are addressed in the state-specific notice accessible through the Fitness Center – State Privacy Law Addendum.   

Data Security

We have implemented reasonable administrative, technical, and physical measures designed to protect your Personal Information.

Data Retention

We retain your personal information as reasonably necessary to accomplish the purposes we describe in this Privacy Policy to comply with our legal obligations (such as record retention laws that apply to us), to resolve disputes, to demonstrate our services/performance and/or to enforce our legal agreements and policies.

Changes to Our Privacy Policy

We reserve the right to amend this Privacy Policy at our discretion and at any time. When we make changes to this Privacy Policy, we will post the new Privacy Policy at the Privacy & Compliance Policy Center.  We encourage you to review the Privacy Policy posted at the Privacy & Compliance Policy Center.
