Fitness Center – State Law Addendum

This Fitness Center – State Privacy Law Addendum (“Addendum”) provided by the fitness centers (“Fitness Centers” or “we” or “our”) owned or operated by Premise Health Employer Solutions, LLC (“Premise Health”) supplements the information contained in the Fitness Center – Website Privacy Policy (“Privacy Policy” or “Policy”) and describes our privacy practices under certain state laws, to the extent such laws apply.

The following state-specific privacy notices are incorporated into this Addendum:

• California Resident Privacy Notice, which describes rights provided to California residents under the California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act (CPRA)
• Colorado Resident Privacy Notice, which describes rights provided to Colorado residents under the Colorado Privacy Act (CPA)
• Connecticut Resident Privacy Notice, which describes rights provided to Connecticut residents under the Connecticut Data Privacy Act (CTDPA), to the extent the CTDPA applies.
• Delaware Resident Privacy Notice, which describes rights provided to Delaware residents under the Delaware Personal Data Privacy Act (DPDPA)
• Florida Resident Privacy Notice, which describes rights provided to Florida residents under the Florida Digital Bill of Rights (FDBR), to the extent the FDBR applies.
• Maryland Resident Privacy Notice, which describes rights under the Maryland Online Data Privacy Act (MODPA)
• Nebraska Resident Privacy Notice, which describes rights provided to Nebraska residents under the Nebraska Data Privacy Act (NDPA), to the extent the NDPA applies.
• Nevada Resident Privacy Notice, which describes rights that may be provided to Nevada residents under the Nevada Consumer Health Data Privacy Act (NCHDPA), to the extent the NCDPH applies.
• Tennessee Resident Privacy Notice, which describes rights provided to Tennessee residents under the Tennessee Information Protection Act (TIPA)
• Texas Resident Privacy Notice, which describes rights provided to Texas residents under the Texas Data Privacy and Security Act (TDPSA), to the extent the TDPSA applies.
• Virginia Resident Privacy Notice, which describes rights provided to Virginia residents under the Virginia Consumer Data Protection Act (VCDPA)
• Washington Resident Privacy Notice, which describes rights that may be provided to Washington residents under the Washington My Health My Data Act (WMHMDA), to the extent the WMHMDA applies.

To the extent there is any inconsistency between the terms of the Privacy Policy and the state-specific privacy notices, the terms of the state-specific privacy notices control.

NOTE:  If a state consumer data privacy law currently in effect is not listed in this State Law Addendum, we have determined the state law: (i) does not apply to Premise Health or the data collected by the Fitness Centers; or (ii) does not require additional notice or provide any consumer rights beyond the notice/rights set out in in our Privacy Policy.
