California Job Applicant Privacy Notice

*This policy replaces Premise Health’s previous California Job Applicant Privacy Notice and Personnel Privacy Practice notice. This policy only applies to California residents. If you are an employee or contractor of Premise Health, other notices and policies may apply to you.
This California Job Applicant/Personnel Privacy Policy (“Privacy Policy” or “Policy”) applies to information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked to, directly or indirectly, a job applicant, employee or contractor (“Job Applicant/Personnel Data”) Job Applicant/Personnel Data does not include (i) information that is deidentified; (ii) aggregate information; (iii) publicly available information; or (iv) lawfully obtained, truthful information that is a matter of public concern.
This Privacy Policy applies to Job Applicant/Personnel Data collected (i) from users of https://jobs.premisehealth.com/ (“Job Site”); (ii) from job applicants, employees and contractors by Premise Health Employer Solutions, LLC (“Premise Health” or “we” or “our”), unless that information is governed by a separate privacy policy available at the Privacy & Compliance Policy Center.
This Privacy Policy describes:
- the types of Job Applicant/Personnel Data we may collect or that job applicants, employees and contractors may provide when visiting the Job Site or applying for a position with Premise Health;
- our practices for collecting, using, maintaining and disclosing that Job Applicant/Personnel Data; and
- a data subject’s rights under the California Consumer Privacy Act and its implementing regulations (“CCPA”) and how a California resident can exercise those rights.
Any terms defined in the CCPA have the same meaning when used in this Privacy Policy.
This Privacy Policy does not apply to:
- Health information we maintain in accordance with the Health Insurance Portability and Accountability Act and its implementing regulations (HIPAA), including information collected or maintained by any Premise Health group health plan. Please contact Premise Health’s Privacy Officer if you have questions regarding the privacy of health plan member information.
- Information Premise Health collects from users of premisehealth.com and any other public Job Sites owned and operated by Premise Health. That information is generally governed by the Job Site Privacy Policy, which is available at the Privacy & Compliance Policy Center. Please note, several links on the Job Site take you to www.premisehealth.com, such as “Contact” at the bottom of the homepage.
- Information collected by third-party Job Sites or applications that may be linked from or accessible through the Job Site. That information is governed by the third party’s privacy policy. (See section below on Links to Third-Party Sites.) Other parties may collect information about your online activities over time and across third-party websites. We encourage you to review the privacy policies of the online services or websites with whom you interact.
Please read this Privacy Policy carefully to understand our policies and practices regarding Job Applicant/Personnel Data. Children’s Privacy
The Job Site is not intended for use by children under the age of 18, and Premise Health does not collect Job Applicant/Personnel Data from children under the age of 18. If you are under 18, do not use or provide any information on the Job Site, including your name or email address, or any other personal information. If you believe we might have Job Applicant/Personnel Data from or about a child, please contact us at [email protected].
Job Applicant/Personnel Data We May Have Collected In The Last 12 Months
Personal Information
In the last 12 twelve months, we may have collected the following categories of information from or about job applicants, employees and contractors (referred to herein as “Personal Information”):
- Identifiers, such as name, alias, postal address, email address(es), phone number(s), social security number and government issued identification number(s) (e.g., state identification card, driver’s license number or passport number);
- Professional or employment-related information, such as employment history, educational background, certificates and licenses, title, date of hire, work schedule and status, compensation history, work eligibility information and other information contained in any resume or cover letter submitted to us, responses to application questions, background checks, credentialing verifications and references, medical information, benefits and leave information, and information related to any legal issues or disputes that may arise during the course of employment or contractor relationship
- Protected characteristics, such as age, race, color, ancestry, national origin, citizenship, religion or creed, marital status, medical condition, physical or mental disability, sex (including gender, gender identity, gender expression, pregnancy or childbirth and related medical conditions), sexual orientation, reproductive health decision making, military and veteran status, or genetic information (including familial genetic information)
- Other types of personal information, such as your signature, photograph or other descriptions of your physical characteristics, birth date, your financial account number(s), debit card number(s), insurance policy number and other insurance or benefits information, and emergency contact information.
- Inferences drawn from other Personal Information we collect, which we use to create a profile that reflects an individual’s abilities and aptitudes.
Technical and Usage Data
In the last 12 months, we may have collected the following categories of Technical and Usage Data:
- If you are an employee or contractor of Premise Health, we may have collected internet and electronic network activity information, including information about your work email account, use of the internet and electronic network, use of our computers, phones and other devices to which you have access. This information includes your browsing and search history.
- If you visit the Job Site, our system may have automatically gathered and stored certain technical and usage data about your visit, including but not limited to the following:
- Geolocation
- Visitor’s domain name
- Visitor’s IP address
- Aggregate information on what pages are accessed
- Name and release number of web browser software used
- Operating system used, device type and browser type
- Date and time you access our site
- Address of the Job Site that linked to us (referral URL)
This Technical and Usage Data may be automatically collected as you navigate through the job Site using Automatic Tracking Technologies (described below).
We may also collect de-identified information about you.
Automatic Tracking Technologies
As you navigate through and interact with the Job Site, we may use automatic collection/tracking technologies (“Automatic Tracking Technologies”) to collect Technical and Usage Data. This information helps us improve the Job Site and to deliver a better and more personalized service, such as by enabling us to do things like:
- Estimate our audience size and usage patterns;
- Store information about your preferences, allowing us to customize our Job Site according to your individual interests;
- Speed up your searches;
- Recognize you when you return to the Job Site;
- Address technical and/or security issues, including verifying system and server integrity; and
- Advertise our services.
Some of these Automatic Tracking Technologies may be required for us to provide a specific feature or service through the Job Site. For example, they may allow us to display the Job Site in the proper format or language. Other cookies may provide a convenience feature to save you time. These Automatic Tracking Technologies may include:
- Cookies. We may use “cookies” to provide useful features to our visitors by providing customizable and personalized services. A cookie is a small amount of data that is sent to your browser from a web server and stored on your computer’s hard drive. For example, we may use cookies on the Job Site to store and sometimes track visitor preferences. We will not link cookies to any Personal Information or health-related information. Your browser software can be set to reject all cookies, or to ask you if you would like to accept or decline a cookie from a particular site before it is set. Most browsers offer instructions on how to reset the browser to reject cookies in the help section of the toolbar. You should know, however, that if you reject a cookie, certain functions and features of the Job Site that are designed for your convenience may not work. See also Decline Use of Cookies and Do Not Track (DNT) Requests sections below.
- Web Beacons. We may also occasionally use “web beacons” (also known as “clear gifs,” “web bugs,” “1-pixel gifs,” etc.) that allow us to collect non-personal information about you. Web beacons are tiny images, placed on a web page that can tell us if you’ve gone to a particular area on a Job Site. We do not collect any Personal Information or health-related information with a web beacon, we do not link web beacons with any health-related information you’ve given us. If you set your browser to decline or deactivate cookies, web beacons cannot function because they are used in conjunction with persistent cookies (described above).
How We May Have Used Job Applicant/Personnel Data In The Last 12 Months
In the last 12 twelve months, we may have used Job Applicant/Personnel Data for the following purposes:
- Recruiting and candidacy: We may use Job Applicant/Personnel Data to evaluate an individual’s candidacy for a position, to perform recruitment, to populate jobs that are relevant to their location, to communicate with an individual when positions matching a Job Alert become available.
- Workforce administration and management: We may use Job Applicant/Personnel Data to verify identity and information, to provide human resources services, to perform tax and social security management, to manage work schedules, to process employee work-related claims, to schedule business travel, and to handle other similar employee administration matters.
- Processing employee benefits: We may use Job Applicant/Personnel Data to administer and process your life, retirement, and other benefits.
- Processing professional or employment-related interactions and transactions: We may use Job Applicant/Personnel Data to process payroll, process expense reimbursements, and manage salaries, sick pay, paid time off, and leaves of absences.
- Complying with federal and state law: We may use Job Applicant/Personnel Data to comply with federal and state laws including any reporting obligations.
- Maintaining security: We may use Job Applicant/Personnel Data to monitor the use of our equipment and property for security purposes, such as detecting security risks and incidents, protecting against fraudulent or illegal activity, verifying and maintaining the quality and security of company-issued devices, and ensuring compliance with our policies and procedures.
- Our own business purposes: We may use Job Applicant/Personnel Data to to perform analytics to discover ways to improve our business, identify trends in our workforce, and enhance our service offerings.
- Facility Cameras: We operate cameras at our facilities and may use pictures or video from those cameras for security purposes.
- Job Site operations, improvement and communications: We may use Job Applicant/Personnel Data to operate, present, maintain and improve the Job Site, track visitors, to customize the Job Site according to individual interests, to monitor, review, measure, and analyze Job Site utilization, to modify and enhance the Job Site, to improve the content and design of the Job Site, to carry out our Terms of Use, to notify you about changes to the Job Site, to communicate with you (if you provide your email address and/or phone number through the Job Site, you are providing your consent to be contacted by those methods); and for any other purpose described to you through the Job Site.
- Other Permissible Purposes: We may use Job Applicant/Personnel Data for any other purpose that is permissible under the laws that apply to us; and for any other purpose to which you consent.
We may create and use de-identified information as permitted by applicable law.
To Whom We May Have Disclosed Job Applicant/Personnel Data In The Last 12 Months
In the preceding 12 months, Premise Health may have disclosed Job Applicant/Personnel Data to the following categories of third-parties with consent:
- Third parties with whom you direct us to share your personal information, such as drug screening vendors, credentialing vendors and consumer reporting agencies for employment background checks.
In the preceding 12 months, Premise Health may have disclosed Job Applicant/Personnel Data to the following categories of third parties without consent:
- To contractors, service providers, and other third parties we use to support our business and the Job Site, or to provide professional services to support our business;
- To Premise Health clients for client payment of invoices for Premise Health services and to confirm background check and/or drug screening compliance for client audits;
- Government agencies when required by law; and
- To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which Job Applicant/Personnel Data is among the assets transferred.
In the preceding 12 months, Premise Health may have disclosed Technical and Usage Data for the purposes discussed in the Automatic Tracking Technologies section above to the following categories of third parties:
- Social media companies
- Digital advertising companies
- Analytics companies
for the purpose of internet-based advertising (including targeted advertising) and to improve our services. *We do not knowingly share this information for individuals under 16 years of age. See section on Children’s Privacy
Information collected directly from you by these third parties is covered by the third parties’ own privacy policies.
We may disclose de-identified information as permitted by applicable law.
We do not disclose or sell your personal information to third parties for their direct marketing purposes.
Decline Use of Certain Cookies
When you first visit the Job Site, you will see a pop-up banner explaining that the Job Site stores cookies on your computer and how we use the information collected through the cookies. You can accept or decline certain use of these cookies. If you decline, Job Applicant/Personnel Data will not be tracked when you visit the Job Site; however, a single cookie will be used in your browser to remember your preference not to be tracked.
Do Not Track (DNT) Requests
Some Job Site browsers have a “do not track” (DNT) feature that lets you tell Job Sites you visit that you do not want to have your online activities tracked. Premise Health currently does not respond to a browser’s DNT signal.
Data Security
We have implemented reasonable administrative, technical, and physical measures designed to protect the information we maintain about you. Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect Job Applicant/Personnel Data, we cannot guarantee the security of information transmitted to the Job Site. You understand and acknowledge that your use of the Internet and sharing of your Personal Information through the Job Site carries risk that data may be intercepted or accessed by unauthorized persons. We are not responsible for your circumvention of any privacy settings or security measures contained on the Job Site.
Data Retention
We retain your personal information as reasonably necessary to accomplish the purposes we describe in this Privacy Policy to comply with our legal obligations (such as record retention laws that apply to us), to resolve disputes, for backup and archival purposes, to demonstrate our performance, and/or to enforce our legal agreements and policies.
Use of the Job Site
Terms of Use
Use of the Job Site is also subject to our Terms of Use. Any disputes related to this Privacy Policy will be governed by the applicable provisions of the Terms of Use, which are incorporated into this Privacy Policy by reference, including without limitation provisions regarding limitations of liability and application of the governing law and dispute resolution policies.
Using the Job Site Outside of the United States
We intend the Job Site to be used only by individuals who are located in the United States. If you are visiting the Job Site from outside the United States, your Personal Information and Technical and Usage Data will be transferred to, stored, and processed in the United States. The data protection and other laws of the United States might not be as comprehensive as those in the country where you are located. By using the Job Site, you understand and agree that Job Applicant/Personnel Data might be transferred to, stored, and processed in the United States and shall be governed by applicable United States law.
Links to Third-Party Sites
The Job Site may include links to third-party sites. This Privacy Policy does not apply to third-party sites, and we are not responsible for those sites. These websites may use cookies and collect your personal information in accordance with their own privacy policies. We encourage you to review the privacy policies of third-party websites you choose to link to from the Job Site to understand how those third-party Job Sites collect, use, and share your personal information.
Social Media Sites
We may engage with you on third party social media sites like Instagram, Facebook, LinkedIn or X (formerly Twitter). If you engage with us on social media, you “opt in” to sharing your content with us. Be aware that the content you submit to social media sites (uploads, posts, comments, shares, “likes” and any messages or tweets) will be publicly visible. To manage the social media notifications you receive or to adjust your privacy settings on your social media accounts, please access the profile section of your social media accounts and follow the directions there.
Data Subject Rights
Under the CCPA, job applicants, employees and contractors have the following rights in terms of Job Applicant/Personnel Data:
- Right to Know
Job applicants, employees and contractors You have the right to know and request the following information relating to Personal Information about them we may have collected and disclosed:
- Specific pieces of Personal Information we collected;
- Categories of Personal Information we collected;
- Categories of sources from which Personal Information is collected;
- Categories of Personal Information that we disclosed for a business purpose;
- Categories of third parties to whom Personal Information was disclosed for a business purpose; and
- The business or commercial purpose for collecting Personal Information.
Please note, we are not required to provide you with this information more than twice in a twelve (12) month period.
- Right to Access
Job applicants, employees and contractors have the right to access and obtain a copy of the specific pieces of Personal Information we have collected about them, upon verification of identity.
- Right to Correct
Job applicants, employees and contractors have the right to request that we correct inaccurate Personal Information that we collected and maintain about them.
- Right to Request Deletion
Job applicants, employees and contractors have the right to request that we delete the Personal Information that we collected from them, subject to certain exceptions under the law. Once we receive and confirm identity, we will delete (and direct our service providers to delete) such Personal Information from our records, unless an exception applies.
- Right to Opt Out
Job applicants, employees and contractors have the right to opt out of certain sharing of their Personal Information. See Decline Use of Certain Cookies section.
- Right Not to Receive Discriminating Treatment
You have the right not to receive discriminatory treatment for exercising any rights described in this Section or in the CCPA.
How to Exercise These Rights

When you exercise a right, we may ask you to provide additional Personal Information, such as your name and email, so that we can properly identify you in our dataset to track compliance with a request. We will only use Personal Information provided in connection with such a request to review and comply with the request. If you choose not to provide this information, we may not be able to respond to your request if we cannot verify your identity (or your authority to make the request for someone else). In certain circumstances, we may decline a request to exercise the rights described above.
You may designate an authorized agent to exercise your rights on your behalf in the same way you can exercise your rights.
Our Response
We will try to respond to a verifiable request within forty-five (45) days of receipt. If we are unable to process your request in such time, we will inform you of the delay in writing by mail or email. Information provided in response to a consumer request will be provided free of charge up to twice annually.
If a request is manifestly unfounded or excessive, in particular because of its repetitive character, we may either charge a reasonable fee, taking into account the administrative costs of providing the information or communication or taking the action requested, or refuse to act on the request and notify you of the reason for refusing the request. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.
Right to Appeal
If we are unable to comply with all or a portion of your request, we will explain the reasons we cannot comply. You may appeal our decision by resubmitting a request and we will inform you of any action taken or not taken in response to the request and explain the reasons for our decision within sixty (60) days of receiving the request.
Changes to Our Privacy Policy
We reserve the right to amend this Privacy Policy at our discretion and at any time. When we make changes to this Privacy Policy, we will post the new Privacy Policy at the Privacy & Compliance Policy Center. We encourage you to review the Privacy Policy posted at the Privacy & Compliance Policy Center every time you use the Job Site.
